YABLOKO opposes the transfer of exclusive rights to represent the state in bankruptcy cases to the Federal Service for Financial Rehabilitation and Bankruptcy (FSFRB) | ||||

Deputies from the YABLOKO faction think that the decision to appoint the Federal Service for Financial Rehabilitation and Bankruptcy (FSFRB) as the only plenipotentiary agency representing the Russian Federation in bankruptcy cases is erroneous. A corresponding resolution was adopted by the Russian government on February 14, 2003.
YABLOKO thinks that such a decision grants the FSFRB extra-judiciary rights and unmotivated intervention in civil disputes between private organisations during bankruptcy proceedings.
In this way the government infringes the interests of the Russian Federation, as it ousts from the bankruptcy process competent and fully informed state power bodies, such as the Ministry on Taxes and Duties, the State Customs Committee and the Ministry of Finance.
The decision adopted by the government also complicates administrative proceedings and puts at risk the fair and honest exercise of their functions by the Ministry on Taxes and Duties, the State Customs Committee and the Finance Ministry.
YABLOKO calls on the Russian government to stay within the logic of the federal law "On Insolvency (Bankruptcy)" and grant the federal executive authorities with access to all the relevant information, experience and highly qualified staff the right to represent the interests of the Russian Federation.
